Energy certification, energy audits of buildings and regular audits of heating systems and cooling or climate control systems in buildings

Authorisation is granted to the natural person meeting the following requirements:

  • completed graduate university study or specialist graduate study of the architectural, civil engineering, mechanical engineering or electrical engineering fields and during the course of study has attained a minimum of 300 ECTS credits, or attained in previous education programmes the academic title of Engineer of the architectural, civil engineering, mechanical engineering or electrical engineering professions*
  • has a minimum of five year work experience in the profession or two year work experience in designing and/or construction supervision*
  • has concluded a professional liability contract for the duration at least until the expiry of the decision on authorisation (5 years)
  • successfully completed the appropriate professional training programme – Module 1 or Module 1 and Module 2
  • no criminal record with regard to one or several criminal activities (association for committing criminal acts, receiving bribes in business operations, offering bribes in business operations, abuse of position and powers, abuse of state powers, illegal mediation, receiving bribes, offering bribes, frauds, computer frauds, frauds in business operations or disguise of illegally obtained money)

* Exceptionally, authorisation for energy certification and energy audits of buildings with simple technical systems may be also granted to a natural person who has completed undergraduate university or undergraduate professional study of the architectural, civil engineering, mechanical engineering or electrical engineering fields, or who by previous education programmes attained the professional title of Engineer in the architectural, civil engineering, mechanical engineering or electrical engineering fields (higher qualifications), and who has a minimum of ten years work experience in the profession, or five years work experience in designing and/or construction supervision upon study completion.

Authorisation is granted to the legal person who meets the following requirements:

  • registered for the activity of energy certification and energy audits of buildings
  • employs at least one natural person on a full time and unlimited time basis who meets the requirements for implementing energy audits of buildings and energy certification of buildings
  • has concluded a professional liability contract in the duration at least until the expiry of the decision on authorisation (5 years)
  • the legal person and the responsible person in the legal person have no criminal record with regard to one or several criminal activities (association for committing criminal acts, receiving bribes in business operations, offering bribes in business operations, abuse of position and powers, abuse of state powers, illegal mediation, receiving bribes, offering bribes, frauds, computer frauds, frauds in business operations or disguise of illegally obtained money)

Authorisation for occasional or temporary provision of services in the Republic of Croatia is granted to a natural or legal person from another member state of the European Economic Area that meets the following requirements:

  • has the professional qualifications necessary for the performance of those activities
  • has no prohibitions on the exercise of the profession
  • has a good command of the Croatian language corresponding to the B2 level
  • has concluded a professional liability contract in the duration at least until the expiry of the period of intended provision of services
  • has no criminal record

Note: a person from another EEA member stare who is established in the Republic of Croatia, has the right to provide services in the territory of the Republic of Croatia upon having obtained authorisation

Authorisation/certificate for occasional or temporary provision of services in another EEA member state is granted to a Croatian citizen (natural and legal person) that meets the following requirements:

  • has the authorisation by the competent Ministry for the provision of services of the regulated profession of energy certification and energy audit of buildings (note: the authorisation/certificate for the provision of services of energy certification and energy audits of buildings for which the applicant has already obtained authorisation)

A person to whom the authorisation for energy certification and energy audits of buildings has been annulled is not allowed to submit an application for a new authorisation prior to the expiry of a one year period from the day of final force and effect of the decision on authorisation annulation.

Required documentation

For a natural person:

  • application form according to Appendix 1A of the Ordinance
  • photocopy of the personal identity card
  • photocopy of the diploma on completed studies
  • photocopy of the confirmation of the Croatian Pension Insurance Fund on the legal employment status and years of service or electronic record of the legal employment status and years of service and/or employer’s certificate on work experience in the profession
  • description of the work experience in the profession on the form from Appendix 1C (chronological list of the jobs held by the person – with singled out at least one example for each of the minimum of five calendar years of work experience in the profession, and by way of exception, persons having completed undergraduate university or undergraduate professional study and who have under previous education programmes attained the title of Engineer (higher qualifications), are required to list ten years of work experience in the profession, with one example for each of the ten calendar years

Note: this only refers to work experience in the profession acquired after having completed graduate university study or specialist graduate study of the architectural, civil engineering, mechanical engineering or electrical engineering fields, and during the course of study the person has attained a minimum of 300 ECTS credits, or attained in previous education programmes the academic title of Engineer of the architectural, civil engineering, mechanical engineering or electrical engineering profession

  • the form from Appendix 1C (with work experience description) shall be provided, in addition to the personal signature, with the stamp of the certified engineer and/or court expert if the natural person has one, and to deliver a copy of the decision on entry into the Directory of certified engineers of the profession, or copy of the decision on dormancy of one’s membership in the chamber
  • photocopy of the certificate of successful completion of the training programme – Module 1 or Module 1 and Module 2
  • photocopy of the professional liability contract (professional liability policy) for potential damages incurred to the investor or other persons, in the duration at least until the expiry of the decision on authorisation (5 years)
  • the insurance contractor and insuree shall be the same natural person – the applicant
  • the insurance subject is liability insurance for damages that may be caused by the natural person in its performance of energy audits of buildings and/or energy certification to the investor, owner or other persons
  • certificate from the municipal court that no verdicts have been passed against the natural person
  • proof of paid administrative fee

For a legal person:

  • application according to Appendix 1B to the Ordinance
  • photocopy of the employment contract of persons employed with the applicant for an unlimited time period who fulfil the requirements and will perform the energy audits of buildings, energy certification and regular audits of heating systems and cooling and climate control systems in buildings,
  • declaration on employed persons and on the appointment of the person for signing reports on carried out energy audits of buildings, energy certificates of buildings and reports on the regular audits of heating systems and cooling and climate control systems in buildings (filled out form from Appendix 1D of the Ordinance)
  • evidence for every appointed and other employed persons (submit evidence for all natural persons who will be performing energy audits of buildings, energy certification and regular audits of heating systems and cooling and climate control systems in buildings in the legal person):
  • photocopy of both sides of the personal identity card
  • photocopy of the diploma of completed study
  • photocopy of the Certificate of successful completion of the Training programme as prescribed by the Ordinance
  • photocopy of the confirmation from the Croatian Pension Insurance Fund on the legal employment status and years of service of employees
  • description of the area of experience – minimum of five years of work experience in the profession on the table appended from Appendix 1C of the Ordinance
  • description of the work experience in the profession on the form from Appendix 1C (chronological list of the jobs held by the person – with singled out at least one example for each of the minimum of five calendar years of work experience in the profession, and by way of exception, persons having completed undergraduate university or undergraduate professional study and who have under previous education programmes attained the title of Engineer (higher qualifications), are required to list ten years of work experience in the profession, with one example for each of the ten calendar years

Note: this only refers to work experience acquired in the profession after having completed graduate university study or specialist graduate study of the architectural, civil engineering, mechanical engineering or electrical engineering fields, and during the course of study the person has attained a minimum of 300 ECTS credits, or after having completed undergraduate university study or undergraduate specialist study of the architectural, civil engineering, mechanical engineering or electrical engineering profession

  • the form from Appendix 1C (with work experience description) shall be provided, in addition to the personal signature, with the stamp of the certified engineer and/or court expert if the natural person has one, and to deliver a copy of the decision on entry into the Directory of certified engineers of the profession, or copy of the decision on dormancy of one’s membership in the chamber; this form shall not be provided with the stamp of the legal person
  • certificate from the municipal court that no verdicts have been passed against the legal person submitting the application and the responsible person in the legal person
  • photocopy of the legal person’s insurance contract (professional liability policy) for potential damages to the investor or other parties, for a minimum duration until expiry of the decision on authorisation (5 years):
  • the insurance contractor and insuree shall be the same legal person – the applicant (without indication of natural persons)
  • the insurance subject is liability insurance for damages that may be caused by the legal person in its performance of energy audits of buildings and/or energy certification to the investor, owner or other persons
  • the insurance contract shall be provided with stamp and signature of the insurance company, and with stamp of the legal persons and signature of the responsible person with the legal person
  • proof of paid administrative fee

For a natural person from a member state of the EEA for occasional or temporary provision of services in the territory of the Republic of Croatia:

  • notification in writing, in accordance with the form from Appendix B to the Ordinance
  • proof of citizenship;
  • proof of business establishment;
  • confirmation of the competent state authority where the applicant is established that at the time of its issuance, there is no prohibition for the performance of activities, neither permanent nor temporary;
  • proof of professional qualifications:
  1. confirmation of the competent authority of the EEA Member State from which the applicant originates on the regulation of the profession and the meeting of all requirements for performing the profession in that country – in the case that energy certification and energy audits of buildings are regulated professions in the country of origin of the applicant,
  2. proof of successfully completed formal education in the architectural, civil engineering, mechanical engineering or electrical engineering professions (diploma attained in an EEA Member State or other evidence issued by the competent authority of the third country, and the foreign person has three years of professional experience within the territory of the EEA Member State, which is confirmed by the EEA Member State),
  3. confirmation of professional experience or confirmation from the employer on attained work experience of a minimum of five years following the completed formal education in the architectural, civil engineering, mechanical engineering or electrical engineering professions,
  4. confirmation of employers from contracting states that the applicant has performed the profession of energy certification and energy audits of buildings at least one year on a full-time basis, or on a part-time basis in the equivalent duration over the past ten years in the EEA Member State in which this profession is not regulated,
  5. proof of professional development and training in the field of energy certification and energy audits of buildings, if in the member state of origin training and professional development programmes are implemented in the area of energy certification and energy audits of buildings,
  6. evidence on the existence of a professional name in the country of establishment;

– proof of a clean criminal record;

– proof of the type of professional liability insurance;

– proof of fluency in Croatian, level B2 (certificate of language knowledge level B2 issued by the authorised institution according to the levels of the Joint European Language Reference Framework (CEF));

– proof of entry into the appropriate register of certified persons, if the EEA Member State keeps such a register.

The above listed documents are submitted as ordinary copies and in uncertified Croatian translations, with the exception of the professional qualifications and proof of a clean criminal record, which are submitted as notarised photocopies and certified translations by a sworn court interpreter.

For a foreign legal person from an EEA Member State, for the purpose of occasional or temporary provision of services in the territory of the Republic of Croatia:

  • written notification according to the form from Appendix A of this Ordinance:
  • proof of business establishment;
  • certificate of the competent state authority in which the applicant is established, that at the time of its issuance, there are no prohibitions on the performance of activities;
  • proof of the professional qualifications of appointed persons and other persons who will perform the energy certification and energy audits of buildings on behalf of the legal person:
  1. confirmation of the competent authority of the EEA Member State of origin of the applicant on the regulation of the profession and the meeting of all requirements for performing the profession in that country – in the case that energy certification and energy audits of buildings are regulated professions in the country of origin of the applicant,
  2. proof of successfully completed formal education in the architectural, civil engineering, mechanical engineering or electrical engineering professions (diploma attained in an EEA Member State or other evidence issued by the competent authority of the third country, and the foreign person has three years of professional experience within the territory of the EEA Member State, which is confirmed by the EEA Member State),
  3. confirmation of professional experience or confirmation from the employer on attained work experience of a minimum of five years following the completed formal education in the architectural, civil engineering, mechanical engineering or electrical engineering professions of the appointed person and others persons who will perform energy certification and energy audits of buildings on behalf of the legal person,
  4. confirmation of employers from contracting states that the appointed person and others persons who will perform energy certification and energy audits of buildings on behalf of the legal person have performed the profession of energy certification and energy audits of buildings at least one year on a full-time basis, or on a part-time basis in the equivalent duration over the past ten years in the EEA Member State in which this profession is not regulated,
  5. proof of professional development and training in the field of energy certification and energy audits of buildings, if in the member state of origin training and professional development programmes are implemented in the area of energy certification and energy audits of buildings,
  6. evidence on the existence of a professional name in the country of establishment;
  • proof of a clean criminal record;
  • proof of the type of professional liability insurance;
  • proof of fluency in Croatian, level B2 of the appointed person and others persons who will perform energy certification and energy audits of buildings on behalf of the legal person (certificate of language knowledge level B2 issued by the authorised institution according to the levels of the Joint European Language Reference Framework (CEF));
  • proof of entry into the appropriate register of certified persons, if the EEA Member State keeps such a register.

The above listed documents are submitted as ordinary copies and in uncertified Croatian translations, with the exception of the professional qualifications of the appointed person and others persons who will perform energy certification and energy audits of buildings on behalf of the legal person, and the proof of a clean criminal record, which are submitted as notarised photocopies and certified translations by a sworn court interpreter.

For Croatian citizens (authorised natural and authorised legal persons) for purposes of providing services in another EEA member state:

  • Application for issuance of the Confirmation in accordance with Appendix 1 or Appendix 2 of the Ordinance.
  • legal persons also enclose to the application an excerpt from the court register, in original or as notarised photocopies not older than 6 months

Fees

35 HRK – administrative fees for issuance of the decision on authorisation for energy certification and energy audits of buildings

E-PROCEDURE for obtaining authorisation for the performance of service activities

  • The form shall be completed and personally signed
  • The form shall be sent to the e-mail address of the competent authority, together with all the required documents, in scanned PDF format
  • If the documents are sent by e-mail, the submitter shall have no obligation of sending them by regular mail or delivering them in person
  • Upon request, the authorisation/decision on the performance of activities may be delivered by the proceeding authority by e-mail. The said document shall subsequently also be delivered by regular mail. The time limit is 30 days from an orderly submitted application.
  • Upon receipt of the authorisation performance of service activities may be begun

Legal remedy

No appeal is permitted against the decision, however an administrative suit may be filed with the administrative court within 30 days from the date of delivery of the decision.
