Requirements for performing babysitting activities

The Social Welfare Centre at the headquarters of the regional self-government unit or the Centre for Social Welfare of the City of Zagreb carries out activities related to the babysitting activities which were previously in the scope of the family centre activities (Social Welfare Act, Official Gazette no. 157/13).

The Social Welfare Centre decides in the first instance on meeting the requirements for performing babysitting activities; decides in the first instance about the registration of a babysitter in the babysitting directory and the registration of assistant babysitters into their respective registry; keeps a register of persons engaged in babysitting and assisting activities and carries out professional supervision over the implementation of a special regulation regulating babysitting activities.

  • The Social Welfare Centre determines the fulfilment of the requirements for performing babysitting activities which include the provision of keeping, caretaking, and guarding for children up to 14 years of age in a living or business space used for babysitting activities or in the parents’ living space.
  • Requirements for performing babysitting activities can be carried out by a registered trader who meets the requirements for performing babysitting activities.
  • Babysitting activities, carried out within the scope of a registered activity are carried out by a person who fulfils personal and professional requirements for babysitting, and carries them out as a registered trader or an employee in a trade.
  • Regardless of whether a babysitter performs the work as a registered trader or an employee in a trade, a babysitter must be entered into the directory of babysitters.

The procedure for examining the requirements for performing babysitting activities shall be initiated at the request of the party/trader submitted to the Social Welfare Centre. On the basis of the procedure conducted, which was accepted on the applicant’s request, the Social Welfare Centre performs the registration of the applicant in the register of persons performing the babysitting activity.

Required documents

  1. If a person wishes to carry out babysitting activities as a registered trader he/she must obtain the decision of the Social Welfare Centre on the fulfilment of requirements for performing babysitting activities which requires the following documentation:
  • a document confirming the registration of the trade in the trade register
  • a decision on the entry of a trader into the babysitting directory
  • a decision of the state administration office in the county or the administrative body of the City of Zagreb on meeting the spatial conditions
  • an insurance contract with an authorized insurance company
  1. If a person wants to perform the babysitting activities as an employee of the trader, he/she only has to be registered in the directory of babysitters provided legal requirements are fulfilled.

Compensation

Administrative tax in the amount of HRK 50.00 according to Tariff number 2.2. of administrative fees tariffs pertaining to the Administrative Fees Act (OG 115/16) are charged at the competent Social Welfare Centre.

Requirements for meeting the conditions for babysitter and assistant babysitter

A person wishing to perform the babysitting activities as a trader or an employee in a trade must be registered into the directory of babysitters. The entry into the directory of babysitters is carried out at the request of a babysitter, on the basis of which the Social Welfare Centre makes a decision on fulfilment of the conditions for a babysitter and approves the registry into the Babysitter Directory.

An assistant babysitter is a natural person employed by a trader who carries out the babysitting activities and who directly and personally provides assistance to the babysitter and is entered into the Directory of Assistant Babysitters. The entry into the Directory of Assistant Babysitters is carried out at the request of an assistant babysitter, on the basis of which the Social Welfare Centre makes a decision on fulfilment of the conditions for an assisting babysitter and approves the registry into the Directory of Assistant Babysitters.

Additional obligations

  1. The trader is obligated to report to the competent Social Welfare Centre any changes in circumstances or data recorded in the Registry of Babysitters.
  2. Any change in the data recorded in the Directory of Babysitters or Assistant Babysitters, the babysitter or the assistant babysitter is obligated to report to the relevant Social Welfare Centre for the purpose of amending the records in the Directory of Babysitters or Assistant Babysitters.

E-PROCEDURE for obtaining approval for performing service activities

  • The form must be completed and signed personally
  • The form shall be sent to the email of the competent procedural body (Social Welfare Centre), along with all necessary documents and an e-payment receipt of the administrative fee – in a scanned PDF format
  • If the documents are sent by e-mail, there is no obligation to send them by regular mail or to deliver them personally
  • The approval/decision for performance of the activity can be obtained by e-mail from the competent procedural body on request. The document will be sent additionally by regular mail as well. The deadline for the approval is 30 days from the date of the application.
  • The applicant may begin to perform the babysitting activity upon submitting the final decision to the competent state administration office in the county or the administrative body of the City of Zagreb.

Legal remedies

An appeal against the decision on fulfilment of the conditions for performing babysitting activities may be submitted to the Ministry of Demography, Family, Youth and Social Policy within 15 days from the day of receipt of the decision.

An appeal against the decision on the annulment of the decision on the fulfilment of the conditions for performing babysitting activities, issued due to cessation of fulfilment of any requirement pertaining to this Act, may be submitted to the Ministry of Demography, Family, Youth and Social Policy within 15 days from the day of receipt of the decision.

An appeal against the decision on fulfilment of the conditions for performing assistant babysitting activities may be submitted to the Ministry of Demography, Family, Youth and Social Policy within 15 days from the day of receipt of the decision.

An appeal may be filed to the Ministry of Demography, Family, Youth and Social Policy against the decision on the removal of the trader from the Registry within 15 days from the date of receipt of the decision.

An appeal against the decision entry into Directory of Babysitters may be submitted to the Ministry of Demography, Family, Youth and Social Policy within 15 days from the day of receipt of the decision.

An appeal against a decision on the removal of a babysitter from the Directory of Babysitters may be filed to the Ministry of Demography, Family, Youth and Social Policy within 15 days from the date of receipt of the decision.

The state administration office in the county or the administrative body of the City of Zagreb issues a decision determining whether the spatial conditions for carrying out babysitting activities have been met which are set out by the Ordinance on the conditions of space, equipment of premises with appropriate equipment and other conditions for carrying out babysitting activities. An appeal may be filed to the Ministry of Demography, Family, Youth and Social Policy against the said decision within 15 days from the date of the receipt of the decision.
