The procedure of evaluating the fulfilment of minimum standards for provision of social services

Social services are provided by social welfare institutions (social welfare homes, community-based service centres, home assistance centers), associations, religious communities, companies, and other domestic and foreign legal persons and small business owners. Companies and small business owners may provide social services only along their other activities, in a separate organizational unit.

Before they initiate any activity, social service providers must:

  • fulfil minimum conditions set for provision of social services and
  • be registered in corresponding registers or records (Registry of Social Welfare Institutions; Records on natural persons providing social services professionally; Records on legal persons, or small business owners providing social services).

The procedure of evaluating the fulfilment of minimum standards, based on beneficiary categories receiving social services, is carried out by:

  • a ministry competent for social welfare affairs (the Ministry for Demography, Family, Youth and Social Policy) or
  • a regional self-government unit.

The Ministry carries out a procedure of evaluating the fulfilment of minimum conditions for provision of social services, in cases of following beneficiary categories:

  • children and young adults without parents or without adequate parental care;
  • pregnant women or a parent with a child up to one year of age;
  • children and young adults with behavioural difficulties;
  • children with developmental disabilities;
  • adults with disabilities;
  • persons addicted to alcohol, drugs, gambling and other forms of addiction;
  • victims of domestic violence and victims of human trafficking.

A regional self-government unit carries out a procedure of evaluating the fulfilment of minimum conditions for provision of:

  • social services for elderly and disabled persons;
  • social services for homeless persons;
  • social service of home assistance, and
  • services provided professionally by natural persons.

Required documents:

The procedure of evaluating the fulfilment of minimum conditions for provision of social services is initiated following the applicant’s submitted request. The request should indicate the address of a social service provider and a beneficiary category to which social services are provided, including the type of social service.

Please note: In case a request for evaluation of the fulfilment of minimum standards is submitted for a social welfare home, before they initiate any activity applicants should enclose:

  • draft Statute
  • decision issued by the Commercial Court, on registration in the Court Register
  • a list of required professional workers and other staff
  • a copy of facility plans and home equipment documents

The E-PROCEDURE of evaluating the fulfilment of minimum conditions for provision of social services:

  • complete the form and sign it manually
  • submit the form by electronic mail to the address of a competent authority, with all required documents enclosed to the message (where such requirements are specified)
  • applicants that submitted documents by electronic mail are not required to submit such documents in person or by regular postal service;
  • Decision on fulfilment of minimum standards, upon applicant’s request, can be delivered by electronic mail. This Decision is also delivered by registered mail.

Before they initiate activities, social service providers must be registered in corresponding registers or records:

  • Registry of Social Welfare Institutions;
  • Records of natural persons providing social services professionally;
  • Records of legal persons, or small business owners providing social services.

Registry of Social Welfare Institutions

Before they initiate activities, the following institution must file a request for registration in the Registry of Social Welfare Institutions:

  • social welfare home
  • community-based service center and
  • home assistance center.

Applicants must supplement a request for registration with:

  • the document of the foundation of the institution
  • a decision issued by a competent institution, which determines the fulfilment of prescribed conditions for initiation of activities of a concerned institution
  • draft Statute.

Filing a request for subsequent changes in the Registry of Social Welfare Institutions:

Social welfare home, community-based service center and home assistance center is required to file a request for any change occurring related to institution’s name, address, founder, authorised representative, activities, increase in capacity, etc.

E-PROCEDURE for filing a request for registration in the Registry of Social Welfare Institutions:

  • complete the form and sign it manually;
  • submit the form by electronic mail to the address of a competent authority, with all required documents enclosed to the message (where such requirements are specified)
  • applicants that submitted documents by electronic mail are not required to submit such documents in person or by regular postal service;
  • Certificate on registration in the Registry of Social Welfare Institutions, upon applicant’s request, can be delivered by electronic mail. This certificate is also delivered by registered mail.

REGISTRATION IN THE REGISTRY OF SOCIAL WELFARE INSTITUTIONS

Records of natural persons providing social services professionally

Before initiation of activities, a request for registration in the Records of natural persons providing social services professionally must be filed by a natural person providing professionally:

  • accommodation service, or sojourn service in a family home;
  • counselling services at a counselling center
  • home assistance service

Applicants must supplement a request for registration with:

  • executive decision issued by a competent institution, on fulfilment of minimum conditions for provision of social services

  • complete the form and sign it manually;
  • submit the form by electronic mail to the address of a competent authority, with all required documents enclosed to the message (where such requirements are specified)

Records of legal persons, or small business owners providing social services.

A request for registration in the Records of legal persons, or small business owners must be filed by:

  • association providing care for socially vulnerable categories of persons;
  • religious community;
  • company;
  • other domestic and foreign legal person and
  • small business owner.

Applicants must supplement a request for registration with:

  • executive decision issued by competent institution, on fulfilment of minimum conditions for provision of social services
