Permanent court expert witness

Requirements

Physical entities meeting the following requirements can be appointed permanent court expert witnesses:

– They are nationals of the Republic of Croatia, nationals of EU member countries, or nationals of a country party to the Agreement on the European Economic Area

– They are medically competent to perform the activities of permanent court expert witness

– After completing an applicable university course of studies or school, they have obtained professional experience, specifically:

– a) Minimally 8 years – if they completed an applicable university graduate course of studies or specialist graduate course of studies

– b) Minimally 10 years – if they completed an applicable university undergraduate course of studies or undergraduate professional course of studies

– c) Minimally 12 years – if they completed an applicable high school, providing that a corresponding university undergraduate course of studies or undergraduate professional course of studies, i.e. university graduate course of studies or specialist graduate course of studies, does not exist in that particular line of profession

4) They have successfully completed professional training

5) They have liability insurance for the performance of permanent court expert witness activities

Permanent court expert witness must not fail to meet any of the requirements stipulated for civil servants.

Documents to be submitted

  1. Application to be appointed permanent court expert witness in a certain line of profession
  2. Résumé
  3. Certificate of citizenship
  4. Certificate of no pending criminal procedure against the Applicant issued by the competent court
  5. Diplomas proving professional training
  6. Certificate on years of employment in the particular line of profession (issued by the employer)
  7. Certificate on medical fitness to perform court expert witness activities issued by a physician – specialist in occupational medicine
  8. Liability insurance policy for the performance of permanent court expert witness activities issued by an insurance company of choice (minimal sum insured: HRK 200,000). Insurance contracts shall be entered into by court expert witness candidates after completing their training, i.e. immediately prior to taking their oath.

Legal remedies

The Candidate can appeal against a decision declining permanent court interpreter appointment to the County or Commercial Court that issued such decision within 15 days after the service thereof. The Ministry of Justice of the Republic of Croatia shall resolve the appeal.
