Hospitality and catering services

The first option – FREEDOM TO PROVIDE CROSS-BORDER SERVICES

If you are already established in any EU/EEA country, you are free to provide services on an occasional and temporary basis, without the obligation of register establishment in Croatia.

In this case, an e-statement at pravni@mints.hr, with photographed or scanned delivery of the following information or documentation (with signature without stamp). The service is provided under the conditions prescribed for business establishment (Second option).

The second option – FREEDOM TO ESTABLISH

If you are established in EU/EEA country, you as natural or legal person, have freedom to provide services on a permanent basis in Croatia, if you register an establishment in Croatia and submit the following documentation i.e. fulfil  the following conditions:

  • request for obtaining a decision on approval for the provision of hospitality and catering services
  • Personal Identification Number (OIB) or an excerpt from the court (for a legal person) or trade register (for a physical person) with a registered activity for performing hospitality and catering activities
  • proof of the right to use business premises (purchase agreement, excerpt from the land register as proof of ownership, lease agreement, etc.)
  • proof of “usability” of the building (according to the Building Act)
  • general and specific conditions for the type, ie. type and category of the facility
  • noise protection requirements (according to the Noise Protection Act)

Fees

EUR 18.58 for types: Restaurant, Inn, Snack Bar, Pizzeria, Bistro, Pastry Shop, Fast Food, Catering

EUR 74.32 for types: Nightclub, Night bar, Disco club

EUR 27.87 for types: Coffeehouse, Café, Pub, Buffet, Tavern, Tasting room

EUR 18.58 for types: Simple services facility in kiosk, Simple fast service facility, Simple service facility in stationary vehicle (or trailer), Simple service facility in a tent, Simple service facility on a bench, Simple service facility on pushcart (or similar devices)

EUR 27.87 for types: Hostelry, Children’s resort, Hostel, Mountain lodge, Hunting lodge, Pupil or Students homes or akademis, Facilities for Robinson accommodation

EUR 27.87 for types: Camp Resting Site

EUR 92.91 for types: Hotel, Aparthotel, Heritage Hotel, Tourist Resort, Tourist Suite, Boarding House, Diffused Hotel, Integral Hotel (Joint), Health Resorts, Special Standard Hotels up to 100 accommodation units

EUR 139.36 for types: Hotel, Aparthotel, Heritage Hotel, Tourist Resort, Tourist Suite, Boarding House, Diffused Hotel, Integral Hotel (Joint), Health Resorts, Special Standard Hotels over 100 accommodation units

EUR 92.91 for types: Camp, Glamping up to 100 accommodation units (up to 300 persons)

EUR 139.36 for types: Camp, Glamping over 100 accommodation units

EUR 18.58 for types: Room, Apartment, Studio Apartment, Holiday Home

Payment through Internet Banking.

Payments are made according to the State budget, depending on the county.

The Ministry provides payment information for the groups „Hotels“ and Camps and Glampings:

Costs of the procedure (per diems, travel and accommodation costs for the members of the commission (if any, to be paid later)

Authorization

Decision on meeting minimum requirements for type and requirements for category

Deadline: 60 days 


Legal remedies  

Possibility to appeal to the Ministry of Tourism and Sport, Prisavlje 14, 10 000 Zagreb or to pisarnica@mints.hr, within 15 days of delivery of the decision, without paying the administrative fee. 

No appeal is allowed against the decision of the Ministry of Tourism and Sports, but an administrative dispute may be initiated by filing a lawsuit with the Administrative Court in Zagreb within 30 days from the delivery of the decision. The lawsuit is submitted to the Administrative Court in Zagreb directly in writing, verbally on the record with that Court or sent by mail, ie submitted electronically.
