Waste management (entry into the registers)

  1. The Ministry of Environment and Energy shall keep the following registers for carrying out waste management activities:
  • Register of Waste Carriers,
  • Register of Waste Management Brokers,
  • Register of Waste Dealers,
  • Register of Recycling Yards,
  • Register of waste recovery
  • The by-product register,
  • End of waste register.

Requirements for carrying out activities:

  1. A legal or natural persons – craftsmen who transport waste shall be obliged to have in their vehicles documentation on the shipment of waste. A legal or natural person – craftsman – may carry out waste transport activities if entered into the Register of Waste Carriers.
  • A person shall be entered in the register of a waste carrier if he submits a request and is registered for an activity in accordance with the Ordinance on waste management.
  1. A legal or natural person – craftsman – may provide waste management brokering services if entered into the Register of Waste Management Brokers.

A person shall be entered in the register of a waste management brokering services if he submits a request and is registered for an activity in accordance with the Ordinance on waste management.

  1. A legal or natural person – craftsman – may carry out waste trading activities if entered into the Register of Waste Dealers.
  • A person shall be entered in the Register of waste dealers if he submits a request and upon request submits the appointment of the person responsible for waste management and if he is registered for the activity in accordance with the Ordinance on waste management
  • A waste trader is considered to be the owner of the waste he has purchased and can take possession of a shipment of a certain type and quantity of waste in possession if he has a waste warehouse for which a valid waste permit has been issued or a recycling yard registered in the Recycling Yard Register or has a storage service contract appropriate waste with the person who manages the recycling yard recorded in the Recycling Yard Register or warehouse for which a valid waste management permit is in place.
  1. A legal or natural person – craftsman – may carry out waste collection in a recycling yard if entered into the Register of Recycling Yards. A person shall be entered in the Recycling Yard Register if, upon request, he / she provides evidence that the following conditions are met:
  • that he has been registered for an activity in accordance with the Ordinance on waste management
  • to have a recycling yard which is a building for which an act has been issued authorizing the use or to have a mobile unit for which a product declaration of conformity has been issued,
  • has obtained approval for the establishment of a recycling yard by a local government unit other than the service provider, that the recycling yard is marked in accordance with the Ordinance on waste management requirements;
  • that it has appointed a person responsible for waste management.
  1. The application for entry in the By-Product Register shall be submitted on the form enclosed with:
  • evidence that the continued use of that substance or article is ensured
  • evidence that the substance or article can be used directly or by normal industrial processes,
  • evidence that the substance or object is an integral part of the manufacturing process,
  • evidence that the continued use of the substance or object is permissible, or that the substance or object fulfills all relevant product, environmental and human health requirements for that particular use and will not lead to significant adverse effects on the environment or human health.

The Ministry shall enter the by-product in the By-Products Register and issue a decision on it if it determines that the following conditions are fulfilled:

  • that the continued use of the substance or article constituting the by-product is ensured,
  • that the substance or object can be used directly without further processing, except by usual industrial processes,
  • that the substance or object is formed as an integral part of the manufacturing process and
  • that the continued use of the substance or object is permissible, that is, the substance or object fulfills all relevant product, environmental and human health requirements for that particular use and will not lead to significant adverse effects on the environment or human health.
  1. The waste holder may revoke the waste status for a particular type of waste if the revocation of the waste status he is working on is recorded in the End of waste register. The application for entry in the Register of Revocation of Waste Status shall be submitted on the form enclosed with:
  • evidence that there is a market or demand for the substance or object,
  • a statement of intent to use the substance or object seeking to be abolished, if the substance or object sought to be abolished is used in the manufacturing process of the person applying for, or intended to be used by, the person for the abolition of the waste status;
  • a waste management permit for the waste recovery activity or other act authorizing waste recovery,
  • the certificate of conformity of the management system or the certificate of registration in the EMAS system register or the certificate of conformity of the system applied under a specific regulation and a document of this system specifying the scope of the quality management system;
  • certificate of accreditation of the certification body issued by the competent accreditation body,
  • Proof of meeting the specific criteria for abolishing waste status.
  1.  A legal or natural person – a craftsman may perform the procedure of recovering certain waste for which it is not necessary to obtain a waste management permit, if it is entered in the Register of waste recovery for which it is not necessary to obtain a waste management permit.

Recovery procedures that can be performed by a person registered in the Waste Recovery Register for which it is not necessary to obtain a waste management permit are:

  • biological aerobic recovery (composting) of bio-waste
  • biological anaerobic recovery (biogas production) of bio-waste
  • energy recovery of certain non-hazardous waste,
  • waste recovery procedures prescribed by the ordinance governing waste management,

The energy recovery of certain non-hazardous waste shall be carried out only with the following waste:

  • vegetable waste from agriculture and forestry, with the exception of straw and other non-hazardous agricultural or forestry material
  • fibrous vegetable waste produced by the production of pulp and paper, if energy recovery is carried out at the place of its production and using the heat produced,
  • wood waste other than that which may contain halogen organic compounds or heavy metals as a result of treatment with wood preservatives, coatings or adhesives, and wood waste resulting from construction or demolition,
  • cork waste

A person shall be entered into the Register of waste recovery if it submits a request accompanied by the documentary evidence of meeting the following requirements

  • that it has been registered for the activity in which the benefits derived from the recovery of waste are used,
  • dispose of waste recovery facilities and equipment,
  • dispose of the building for which an act of use has been issued, in accordance with the regulation governing the construction,
  • has appointed a person responsible for waste management
  • to have a financial guarantee

  1. Without the need to apply in person (saving at least half the time).

  4. The competent authority is obliged to issue an approval within 30 days (from date of duly submitted documentation, after the deadline for administration reply has expired).
  5. Once the approval is obtained, performance of this service activity can begin.

An appeal may not be lodged against the decision, however an administrative dispute may be instituted. The legal remedy is an integral part of every decision.
