{"id":2010,"date":"2022-08-29T13:37:49","date_gmt":"2022-08-29T11:37:49","guid":{"rendered":"https:\/\/psc.hr\/en\/?page_id=2010"},"modified":"2025-09-19T12:38:56","modified_gmt":"2025-09-19T10:38:56","slug":"electronic-communications","status":"publish","type":"page","link":"https:\/\/psc.hr\/en\/electronic-communications\/","title":{"rendered":"Electronic communications"},"content":{"rendered":"<h1><strong>First Option &#8211; FREEDOM TO PROVIDE CROSS-BORDER SERVICES<\/strong><\/h1>\n<p>If you already have a registered business establishment in another EU\/EEA country, you are granted the freedom to provide electronic communications networks and services on an occasional and temporary basis, without the obligation to register an establishment in Croatia, based on a general authorisation.<\/p>\n<p>In that case, the application for the provision, changes and termination of the networks and services is submitted to the Croatian Regulatory Authority for Network Industries (HAKOM) at least 15 days in advance, via a web form available at the <a href=\"mailto:eoperator@hakom.hr\">eoperator@hakom.hr<\/a> link, containing the data:<\/p>\n<ul>\n<li>name of the undertaking<\/li>\n<li>legal status, form and registration number of the undertaking, if the undertaking is registered in a commercial or other similar public register in the European Union<\/li>\n<li>address of the main establishment in the European Union and of the seat or branch in the Republic of Croatia, if any<\/li>\n<li>address of the undertaking&#8217;s website related to the provision of electronic communications networks or services, if any<\/li>\n<li>contact person and details<\/li>\n<li>brief description of the networks or services intended to be provided<\/li>\n<li>name of the European Union Member State in which it will provide or provides networks or services<\/li>\n<li>planned date of commencement or termination of the provision of networks or services.<\/li>\n<\/ul>\n<p>Along with the digitally completed web form, it is necessary to submit the following documents, photographed or scanned:<\/p>\n<ul>\n<li>decision on entry into the court register or decision on entry into the trade register<\/li>\n<li>power of attorney of the authorized person (if the notification is submitted by an authorized person)<\/li>\n<li>statement of the authorized applicant confirming the accuracy and completeness of the information submitted.<\/li>\n<\/ul>\n<h1><strong>Second Option &#8211; FREEDOM OF ESTABLISHMENT<\/strong><\/h1>\n<p>If you have a registered establishment in another EU\/EEA country, both natural and legal persons are entitled to provide electronic communications networks and services on a permanent basis in Croatia, subject to registering an establishment in Croatia and submitting documentation within the time limit and to that required under the First Option.<\/p>\n<hr \/>\n<h2><strong>Fees<\/strong><\/h2>\n<p>None<\/p>\n<hr \/>\n<h2><strong>Competent authority and regulations<\/strong><\/h2>\n<p>Croatian Regulatory Authority for Network Industries<\/p>\n<p>Ulica Roberta Frange\u0161a Mihanovi\u0107a 9, 10 110 Zagreb<\/p>\n<p>+385 1 7007 007<\/p>\n<p><a href=\"mailto:eoperator@hakom.hr\">eoperator@hakom.hr<\/a><\/p>\n<p>Electronic Communications Act (OG 76\/22 and 14\/24; <a href=\"https:\/\/www.hakom.hr\/hr\/zakoni-2038\/2038\">\u00a0consolidated text<\/a>)<\/p>\n<p>Ordinance on the Manner and Conditions of Providing Electronic Communications Networks and Services (<a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/2023_07_86_1346.html\">OG 86\/23<\/a>)<\/p>\n<hr \/>\n<h2><strong>Approval<\/strong><\/h2>\n<p>HAKOM issues a confirmation of the submission of prior notification, with a reference to the rights that operators have under the general authorization. This certificate is not an administrative act.<\/p>\n<p>Issuance deadline: 7 days from the date of receipt of complete prior notification<\/p>\n<hr \/>\n<h2><strong>Legal remedies<\/strong><\/h2>\n<p>No legal remedy is available, since no act is issued on which the commencement of the activity depends.
