<strong>FREEDOM TO ESTABLISH<\/strong><\/h1>\n<p>If you are established in EU\/EEA country, you as physical or legal person, have freedom to provide services on a permanent basis in Croatia, if you register an establishment in Croatia and submit the following documentation i.e. fulfil\u00a0 the following conditions:<\/p>\n<ul>\n<li>request for obtaining a decision on meeting the requirements for the type and category of nautical tourism port or a decision on meeting the requirements for the type of other facility for the provision of vessel berthing and accommodation services<\/li>\n<li>OIB or an excerpt from the court register (for a legal entity) or trade register (for a natural person) with a registered activity for the provision of services in nautical tourism<\/li>\n<li>proof of the right to use business premises (purchase agreement, excerpt from the land register as proof of ownership, lease agreement, etc.)<\/li>\n<li>concession, if necessary (in accordance with special regulations governing concessions on maritime domain)<\/li>\n<li>proof of \u201cusability\u201d of the building (according to the Construction Act)<\/li>\n<li>general and special <a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/full\/2019_12_120_2374.html\">conditions<\/a> for the type, and category of nautical tourism port or the type of other facility for the provision of vessel berthing and accommodation services<\/li>\n<\/ul>\n<hr \/>\n<h2><strong>Fees<\/strong><\/h2>\n<p>EUR 27.87 for decision for anchorage, dry storage, nautical mooring<\/p>\n<p>EUR 92.91 for dry marina decision<\/p>\n<p>EUR 139.36 for marina decision<\/p>\n<p>Payment via internet banking<\/p>\n<p>Payments are made according to the state budget, depending on the county.<\/p>\n<p>Information on payment for marinas is provided by the Ministry.<\/p>\n<hr \/>\n<h2><strong>Application<\/strong><\/h2>\n<div class=\"featuredBlock\">\n<p>First option: <a href=\"https:\/\/gov.hr\/hr\/portal-eturizam\/2473\">e-service<\/a> (for EU\/EEA citizens)<\/p>\n<p>Second option: <a href=\"mailto:pisarnica@mints.hr\">pisarnica@mints.hr<\/a> or <a href=\"https:\/\/jpt.gov.hr\/Prod\/\">Administration office for the county<\/a> (for sending photographed or scanned documentation; competent administrative bodies according to the place where the anchorage, dry storage, nautical mooring is located:<\/p>\n<p>Administration office for the county, i.e. the administrative body of the City of Zagreb competent for tourism<\/p>\n<p>Act on the Provision of Services in Tourism <a href=\"https:\/\/mint.gov.hr\/UserDocsImages\/2021_dokumenti\/211202_ZoPUUT.pdf\">(OG 130\/17, 25\/19, 98\/19, 42\/20 and 70\/21 &#8211; consolidated text)<\/a><\/p>\n<p>Ordinance on the categorization of nautical tourism ports and the classification of other facilities for the provision of berth services and accommodation of vessels <a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/full\/2019_12_120_2374.html\">(OG 120\/19)<\/a><\/p>\n<p>Construction Act (OG <a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/2013_12_153_3221.html\">153\/13<\/a>, <a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/2017_03_20_456.html\">20\/17<\/a>, <a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/2019_04_39_802.html\">39\/19<\/a>, <a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/2019_12_125_2489.html\">125\/19<\/a>)<\/p>\n<p>Ordinance on simple and other constructions and works (OG <a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/2017_11_112_2625.html\">112\/17<\/a>, <a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/2018_04_34_656.html\">34\/18<\/a>, <a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/2019_04_36_755.html\">36\/19<\/a>)<\/p>\n<hr \/>\n<h2><strong>Authorization<\/strong><strong>\u00a0<\/strong><\/h2>\n<p>Decision on meeting the minimum requirements for the type and category for the marina<\/p>\n<p>Decision on meeting the minimum requirements for other facilities for the provision of berth services and accommodation for nautical tourism vessels<\/p>\n<p>Deadline: 60 days<\/p>\n<hr \/>\n<h2><strong>Legal remedies <\/strong><strong>\u00a0<\/strong><\/h2>\n<p>Possibility to appeal to the Ministry of Tourism and Sport, Prisavlje 14, 10 000 Zagreb or to <a href=\"mailto:pisarnica@mints.hr\">pisarnica@mints.hr<\/a>, within 15 days of delivery of the decision, without paying the administrative fee.<\/p>\n<p>No appeal is allowed against the decision of the Ministry of Tourism and Sports, but an administrative dispute may be initiated by filing a lawsuit with the Administrative Court in Zagreb within 30 days from the delivery of the decision.
