First option: FREEDOM TO PROVIDE CROSS-BORDER SERVICES

If you are already established in another EU/EEA state, as a natural and legal person you have the freedom to provide services on a temporary and occasional basis, without the obligation of establishment in Croatia and without a prior check. 

In such a case, the legal entity that carries out the activity of professional supervision of construction and/or design or design audits and the legal or natural person – craftsman who performs the activity of construction shall submit an online statement or the statement form directly to the competent authority at strani.izvodaci@mpgi.hr with a copy and translation of the following documents:

  • evidence/an attestation of the right to pursue the activities in the state of establishment or a valid licence/document regulating this right to pursue the activities in another EU/EEA state
  • data on liability insurance valid in the territory of the Republic of Croatia or the EU

To perform the tasks of professional construction supervision and/or design or design audits, a natural person established in another EU/EEA state who is:

The statement shall be accompanied by a copy and translation of the following documents for all the four professions:

  • copy of the identity card
  • evidence of establishment in another EU/EEA state (employer’s statement)
  • attestation that the right to pursue professional activities has not been revoked (certificate of the competent body of the state of establishment)
  • evidence of formal qualifications/professional qualification

or

evidence that the candidate has pursued the profession for at least one year during the previous ten-year period, where the profession in the state of establishment is carried out without a specific authorisation or where the education and professional training leading to that profession is not regulated

  • data on professional liability insurance valid in the territory of the Republic of Croatia/EU
  • proof of paid fee

If an EU certificate is submitted, the following shall not be submitted:

  • evidence of establishment in another EU/EEA state (if applicable)
  • attestation that the right to pursue professional activities has not been revoked (if applicable)
  • evidence of formal qualifications/professional qualifications

Second option: FREEDOM OF ESTABLISHMENT 

If you are established in another EU/EEA state, as a natural or legal person you have the freedom to provide services on a permanent basis in the Republic of Croatia, with the registration of establishment.

Construction and/or execution of construction works may be done by a legal person or natural person – craftsman (hereinafter: the contractor) if it:

  • is registered for the performance of the construction activity, or for the performance of individual works
  • has a site engineer and/or a works manager in its employment, or a manager of less complex works, depending on the works it performs
  • ensures that the construction and/or other works carried out on the construction work are performed by a person with appropriate professional qualifications
  • is insured against liability

A site engineer and/or works manager is a person who has completed an undergraduate university or professional study of architecture or civil engineering or electrical engineering or mechanical engineering, who has acquired at least 180 ECTS credits and has passed the professional exam. The manager of less complex works is:

  • a person who has completed secondary school with the programme for a technician in the architectural or civil engineering or electrical engineering or mechanical engineering profession who has at least five years of work experience in the profession and has passed the professional exam
  • a person who has passed the master craftsman exam in the field of construction or a person who has the right of entry or has obtained an entry in the crafts and trade register to perform the activity for which the master craftsman exam in the field of construction is required

Activities of design and/or professional supervision of construction may be performed by a certified architect/ certified engineer.

Activities of design audits may be performed by a certified civil engineer with at least ten years of work experience in the design of statically complex structures in the field of design audits, who submits data on work experience prescribed by the Ordinance on entry in the class of auditors (OG 50/20).

Activities of professional supervision of construction and/or design or design audits may be performed by:

  • a legal person
  • a sole-practice office
  • a joint-practice office

A legal person may perform the activity of professional supervision of construction and/or design or design audits if it:

  • is registered to perform design and/or professional construction supervision activities
  • has a certified architect or a certified engineer in its employment

For the establishment of a sole-practice office or the establishment of a joint practice office, a natural person shall:

The request for the establishment of a sole-practice office shall be accompanied by a photograph or scan of:

  • copy of identity card
  • proof of paid fee

The request for the establishment of a joint practice office shall be accompanied by a photograph or scan of:

  • copy of identity card
  • agreement on the establishment of a joint practice office
  • proof of paid fee

For entry in the directory of certified architects/certified engineers, a natural person shall:

The application for entry in the class of auditors, shall be submitted by a natural person directly to info@hkig.hr or via the e-Citizens system for the civil engineering profession.

The request shall be accompanied by the following documentation:

  • decision on recognition of professional qualifications
  • proof of paid chamber registration fee

If For entry in the directory of certified architects/certified engineers, a person who has acquired professional qualification in the Republic of Croatia, instead of the decision on the recognition of professional qualification, shall submit:

  • evidence of completed graduate university or professional study of architecture or civil engineering or electrical engineering or mechanical engineering with acquired at least 300 ECTS credits
  • certificate of passed professional exam
  • evidence of professional work experience of at least two years

For entry in the class of auditors, a person who has acquired professional qualification in the Republic of Croatia, instead of the decision on the recognition of professional qualification, shall submit data on work experience prescribed by the Ordinance on entry in the class of auditors (OG 50/20).

Recognition of qualifications  

Application for recognition of a foreign professional qualification for performing activities of design:

Application for recognition of a foreign professional qualification for performing activities of design audits shall be submitted directly to info@hkig.hr or via the e-Citizens system for the civil engineering profession.

The request shall be accompanied by the following documentation, in copies and translation, according to the general system:

  • copy of identity card
  • diploma/certificate and diploma supplement/certificate supplement
  • evidence of authorization to practice the regulated profession in the country of origin

or

confirmation from the employer that the candidate has pursued the profession for at least one year during the last ten-year period which preceded the provision of services, in case that the profession in the state of establishment of the certified person is not regulated

  • proof of paid fee

The request for recognition of a foreign professional qualification of a person of architectural profession, according to the automatic system, shall be submitted directly to clanstvo@arhitekti-hka.hr or via the e-Citizens system with the following documentation in copies and translated:

  • copy of identity card
  • evidence of formal qualification/professional qualification
  • certificate of conformity of the qualification with Directive 2005/36/EU
  • proof of paid fee

Legal remedies

You may submit a complaint within 15 days from the date of delivery of the decision.

The complaint shall be submitted to:

  • Croatian Chamber of Civil Engineers, Ulica grada Vukovara 271, 10000 Zagreb or at info@hkig.hr for the civil engineering profession
  • Croatian Chamber of Electrical Engineers, Ulica grada Vukovara 271, 10000 Zagreb or at elektroinzenjeri@hkie.hr for the electrical engineering profession

The competent Chamber will reject the complaint (if it is untimely), will replace the contested decision with a new one (if the complaint is partially or fully founded) or will submit the complaint to the Ministry of Physical Planning, Construction and State Assets.

The Ministry may reject the complaint, annul the decision in part or in full, or amend it.

The decision of the Ministry shall be delivered to the party through the Chamber no later than 60 days from the submission of a proper complaint.

No appeal may be lodged against the decision of the Ministry, but an administrative dispute may be initiated with the competent Administrative Court of the Republic of Croatia within 30 days of receipt of the decision.
