First option – FREEDOM TO PROVIDE CROSS-BORDER SERVICES
If you are already established in any EU/EEA state, you are free to provide services as a natural or a legal person, on occasional and temporary basis, without obligation to register a company in Croatia provided that you submit the following:
- A statement to trgovina@mingor.hr
- E-application for compliance of retail premises with the minimum technical requirements
- A proof that business premises meet the requirements in accordance with special regulations (on construction of buildings, food hygiene, environmental protection, urban planning, protection and preservation of cultural heritage, protection of life and human health and safety at work)
- A proof on the right to use business premises (title deed or commercial lease agreement)
Second option – FREEDOM OF ESTABLISHMENT
If you are already established in any EU/EEA state, you are free to provide services as a natural or a legal person on a permanent basis by means of an establishment provided that you submit the following:
- E-application for compliance of retail premises with the minimum technical requirements
- A proof on meeting the requirements in accordance with special regulations (on construction of buildings, food hygiene, environmental protection, urban planning, protection and preservation of cultural heritage, protection of life and human health and safety at work)
- A proof on the right to use business premises (title deed or commercial lease agreement)
- Entering a retail activity as an “information society service” into the Register of Companies. i.e. Trades and Crafts Register
Minimum technical requirements (apply to both options)
- Minimum surface area of retail premises no less than 6 m2
- Proper storage of goods
- A proof of the entitlement and intended use of business premisses, and general construction requirements are needed if the e-retailer uses a storage
- General sanitary, health and hygiene requirements are to be fulfilled if the e-commerce refers to food
- Requirements depending on type of goods, type of retail trade in goods, physicochemical and other characteristics of goods (in accordance with special regulations) are to be met
Obligatory information on the provider’s website (apply to both options)
After obtaining the approval, service providers should publish the following information at their website:
- Name and registered office of the business entity (service provider)
- Contact details of the service provider (telephone, e-mail)
- Registration number from the Register of Companies or other public register
- Information that the service provider is subject to the inspection of the State Inspectorate
- Tax number if the service provider is subject to VAT
Fees
EUR 6.64 for commercial premises for non-store retailing (stands, markets, vending machines)
EUR 17.25 for commercial premises up to 200m2
EUR 37.16 for commercial premises bigger than 200m2
Payments are made to the State budget via Internet banking, i.e. to the budget of a county in charge.

Time-limit for obtaining the Decision: 30 days
Legal remedies
The Decision may be appealed to the Ministry of the Economy and Sustainable Development at pisarnica@mingor.hr within 15 days of delivery of the Decision.
