Geodetic activity can be performed with authorization or cross-border provision of services.

 

Category I: Foreign natural and legal persons may perform expert geodetic operations on a occasional or temporary basis in the Republic of Croatia, or permanently, upon fulfilment of the following conditions:

 

First option – FREEDOM TO PROVIDE CROSS-BORDER SERVICES

 

If you already have a registered business establishment in another EU/EEA country or in Switzerland, you have freedom to provide services on a temporary and occasional basis, without obligation of establishment in Croatia, without the obligation to register your establishment in Croatia, mandatory membership in a professional body and wait for prior check.

 

An online declaration is sent in the mentioned case directly to the competent authority at pisarnica@hkoig.hr, with the following information, i.e. documentation photographed or scanned (signed and without stamp):

 

• Proof of professional qualifications for the performance of expert geodetic operations
• Proof of citizenship
• Certificate proving that they perform expert geodetic operations in the capacity of responsible person in an EU/EEA member state or in Switzerland
• Proof that they have not been convicted of a criminal offence, or temporarily or permanently deprived of the right to perform the profession
• Proof of the authority for the performance of expert geodetic operations in the capacity of responsible person in the country of establishment
• Proof of valid professional liability insurance.

 

Foreign legal persons may perform those expert geodetic operations in Croatia, on a temporary and sporadic basis, that they are authorised to perform in line with the regulations of the country where they are established. In such a case, the foreign legal person sends a statement to the State Geodetic Administration at info@dgu.hr with the following information, i.e. documentation (signed and without stamp):

 

• Proof of the right to perform geodetic activities in the country where they are established
• Proof that they employ a person authorised to perform expert geodetic operations in Croatia in the capacity of responsible person
• Proof that the legal person is insured against professional liability for damage that they might cause to clients or other persons while performing geodetic activities, if such insurance covers damages caused in the Republic of Croatia.

 

Second option – FREEDOM TO ESTABLISH

 

If you are established in EU/EEA country or Switzerland, you as a physical or legal person have freedom to provide services on a permanent basis in Croatia, if you register an establishment in Croatia.

 

In such a case, the foreign authorised natural person must obtain an entry in the Chartered Geodetic Engineers’ Directory which is kept at the Croatian Chamber of Chartered Geodetic Engineers. The Application for entry into the Chartered Geodetic Engineers’ Directory is submitted to pisarnica@hkoig.hr, together with the following documents:

 

• Decision on recognising foreign professional qualification
• Proof that they have not been convicted of a criminal offence against official position, against public order, or against the Republic of Croatia
• Proof of payment of the entry fee of EUR 265
• Proof of company registration
• Certificate by the Croatian Pension Insurance Fund on legal work status (not older than 6 months)
• Proof of insurance against professional liability for damage that they might cause to the investor or other persons while performing professional geodetic operations, if such insurance covers damages caused in the Republic of Croatia.

 

Recognition of Qualifications

 

Application for recognition of qualification is submitted at pisarnica@hkoig.hr with the following documents:

 

• Proof of citizenship – a copy of a valid identity document (passport or identity card)
• Diploma/certificate and supplementary qualification document/certificate supplement
• Authorization for performing expert geodetic operations issued by the body competent for issuing authorizations for performing the regulated profession
• Proof that no measure of temporary and/or permanent deprivation of the right to perform the profession has been imposed issued by the body competent for issuing authorizations for performing the regulated profession (not older than 6 months)

Deadline for passing decisions: 8 days from the date of submission of a valid application for any of the above, except 15 days for Decision on recognizing foreign professional qualifications and Certificate of performing expert geodetic operations in the RoC as responsible person on a temporary and sporadic basis.

 

Legal remedies

 

Appeal may be filed against a decision to the State Geodetic Administration to info@dgu.hr within 15 days from the date of the receipt of decision. Appeal, with a fee of HRK 50.00, may be submitted in person or by mail in writing, in 3 copies, to the Croatian Chamber of Chartered Geodetic Engineers.

Appeals are settled within 30, or 60, days.

 

A foreign legal person established in a state contract member of the EEA or Switzerland registered for the performance of geodetic activity in that country may permanently perform such activity in Croatia under the same conditions as legal persons established in Croatia, in accordance with the Act on the Performance of Geodetic Activities and other special regulations.

Category II: APPROVAL FOR THE PERFORMANCE OF EXPERT GEODETIC OPERATIONS

 

A chartered geodetic engineer wishing to perform expert geodetic operations for the purposes of land cadastre and real property cadastre maintenance, expert geodetic operations for the purposes of infrastructure cadastre, expert geodetic operations for the purposes of building cadastre, or joint a geodetic office and legal entity registered for the performance of geodetic activities for the purposes of state survey and expert geodetic operations for the purposes of real property cadastre establishment must obtain an approval from the State Geodetic Administration.

 

A chartered geodetic engineer may perform expert geodetic operations for the purposes of land cadastre and real property cadastre maintenance, expert geodetic operations for the purposes of infrastructure cadastre, expert geodetic operations for the purposes of building cadastre upon obtaining an approval from the State Geodetic Administration, for which an application must be submitted to the State Geodetic Administration at info@dgu.hr with the following documents:

 

• Proof of entry in the Chartered Geodetic Engineers’ Directory (decision granting entry in the Chartered Geodetic Engineers’ Directory and certificate by the Croatian Chamber of Chartered Geodetic Engineers that the chartered geodetic engineer is registered in the Chartered Geodetic Engineers’ Directory and their membership is not on hold)
• Proof that the office where the chartered geodetic engineer performs professional geodetic tasks is registered in the corresponding directory (decision or certificate by the Croatian Chamber of Chartered Geodetic Engineers)
• Proof that the joint geodetic office where the chartered geodetic engineer performs professional geodetic tasks is registered in the corresponding directory (decision or certificate by the Croatian Chamber of Chartered Geodetic Engineers)
• Proof that the legal person where the chartered geodetic engineer performs professional geodetic tasks is registered for performing relevant professional geodetic tasks pursuant to the Act on the Performance of Geodetic Activities (decision granting court register entry or extract from court register)
• Proof of the chartered geodetic engineer’s work experience in the performance of professional geodetic tasks for a period of minimum 3 years (certificate with information from the Croatian Pension Insurance Fund records or work contract or service contract or contract on business cooperation)
• Proof of the chartered geodetic engineer’s professional training attended in the period of last 3 years (certificate by the Croatian Chamber of Chartered Geodetic Engineers).

 

A joint geodetic office and legal entity registered for the performance of geodetic activities may perform expert geodetic operations for the purposes of real property cadastre establishment upon obtaining an approval from the State Geodetic Administration, for which an application must be submitted to the State Geodetic Administration at info@dgu.hr with the following documents:

 

• Proof that the joint geodetic office is registered in the corresponding directory (decision or certificate by the Croatian Chamber of Chartered Geodetic Engineers)
• Proof that the legal person is registered for performing relevant professional geodetic tasks pursuant to the Act on the Performance of Geodetic Activities (decision granting court register entry or extract from court register)
• Proof of entry in the Directory of Chartered Geodetic Engineers (decision granting entry in the Chartered Geodetic Engineers’ Directory and certificate by the Croatian Chamber of Chartered Geodetic Engineers that the chartered geodetic engineer is registered in the Chartered Geodetic Engineers’ Directory and their membership is not on hold)
• Proof of the chartered geodetic engineer’s work experience in the performance of professional geodetic tasks for a period of minimum 3 years (certificate with information from the Croatian Pension Insurance Fund records or work contract or service contract or contract on business cooperation)
• Proof of the chartered geodetic engineer’s professional training attended in the period of last 3 years (certificate by the Croatian Chamber of Chartered Geodetic Engineers)
• Proof of the expert associate’s or associate’s entry in the register of expert associates and associates (certificate by the Croatian Chamber of Chartered Geodetic Engineers)
• Proof that the expert associate or associate has passed or been recognised the professional exam.
