1. The procedure of examining the requirements for performing babysitting activities

  • The procedure for examining the requirements for performing babysitting activities shall be initiated at the request of the party/trader submitted to the Social Welfare Centre and shall be handled as a first instance administrative proceeding.
  • The examination of the conditions for performing babysitting activities shall be carried out by the employees of the Social Welfare Centre.
  •  On the basis of the procedure conducted, in which the applicant’s request is accepted, the Social Welfare Centre ex officio performs the registration of the applicant in the register of persons performing the babysitting activity and delivers the final decision to the Ministry. The applicant may begin to perform the babysitting activity upon submitting the final decision to the competent state administration office in the county or the administrative body of the City of Zagreb.

  • An appeal may be filed against the decision on the applicant’s request to the Ministry responsible for social policy (hereinafter: Ministry).

  • The decision on cancellation of the decision on fulfilment of requirements for performing babysitting activities may be adopted ex officio or at the request of a party if the Social Welfare Centre determines the cessation of fulfilling one of the conditions for performance of babysitting activities
  • Proposal of the party to issue a decision on cancellation
  • An appeal may be filed against the decision on cancellation of the decision on fulfilment of the requirements for performing babysitting activities to the Ministry.

Registry

a) Procedure of entry into the Registry

  • the Centre for Social Welfare keeps a Registry of persons performing babysitting activities in its jurisdiction, which is public and accessible on the Centre’s web pages and submits the aggregated data from the Registry to the Ministry.
  • the entry into the Registry is carried out by the Centre for Social Welfare ex officio on the basis of a decision on fulfilment of requirements for performance of babysitting activities.
  • upon a written request, the Social Welfare Centre issues a certified extract from the Registry to any person requesting access to the data entered in the Registry without the need to prove the legal interest

b) Procedure for deletion from the Registry

  • The Centre for Social Welfare ex officio deletes the trader from the Registry after the enforcement of the decision on cancellation of the decision on fulfilment of conditions for performing babysitting activity
  • An appeal may be filed against that decision to the Ministry

c) Entry of changes to the Registry

The trader is obligated to report to the competent Social Welfare Centre any changes in circumstances or data recorded in the Registry.

2. The procedure of examining the spatial conditions for performing babysitting activities

The fulfilment of spatial conditions for performing babysitting activities in a living or business space is determined by the state administration office in the county or a competent administrative body of the City of Zagreb according to the place where the premises are located, on the basis of the request of the trader intending to carry out the babysitting activities.

The condition of fulfilling spatial conditions for performing babysitting activities does not have to be fulfilled if the babysitting activities will be carried out in the living premises of the children’s parents.

The proceedings are initiated at the request of the party submitted to the state administration office and are conducted as the first instance administrative proceedings.

Determining the fulfilment of spatial conditions is carried out by officials employed in the state administration office. Spatial conditions are prescribed in the Ordinance on the conditions of space, equipment of premises with appropriate equipment and other conditions for carrying out babysitting activities (Official Gazette number 96/13)

3. Decision on entry into the Registry of Trades with the registered babysitting activity

One of the legal preconditions for a party to perform babysitting activities is to be entered into a Registry of Trades with a registered babysitting activities based on a document issued by a competent state administration office.

4. The procedure of examining the requirements for a babysitter

A person must be entered into the Directory of Babysitters:

  • If he/she wants to carry out babysitting activities as a trader with their own trade,
  • If he/she wants to carry out babysitting activities as a an employee in a trade,

a) The procedure of entry into the Directory of Babysitters

  • the Directory of Babysitters is run by a Social Welfare Centre and it is accessible to public on the Centre’s web pages.
  • entry into the Directory of Babysitters is carried out at the request of a babysitter, on the basis of which the Social Welfare Centre makes a decision on fulfilment of the conditions for a babysitter and approves the registration in the Directory of Babysitters. An appeal may be filed against the decision on the applicant’s request to the Ministry
  • upon a request, the Social Welfare Centre issues a certified extract from the Directory of Babysitters to any person requesting access to the data without the need to prove the legal interest

b) Procedure for deletion from the Directory of Babysitters

  • the decision for deletion of a babysitter from the Directory of Babysitters is issued by the Social Welfare Centre when they determine that the babysitter is no longer in compliance with the required conditions or on the request of the babysitter
  • an appeal against the decision of deletion from the Directory of Babysitters can be filed with the Ministry
  • the Centre performs deletion of a babysitter from the Directory ex officio after finalization of the decision on deletion from the Directory of Babysitters

c) Entry of amendments into the Directory of Babysitters

  • a babysitter is obligated to report any changes of the information recorded in the Directory of Babysitters to the Social Welfare Centre with the purpose of entry of such changes into the Directory of Babysitters

5. Procedure of examining fulfilment of the requirements for an assistant babysitter

An assistant babysitter is a natural person employed by a trader who carries out the babysitting activities and who directly and personally provides assistance to the babysitter and is entered into the Directory of Assistant Babysitters.

a) Procedure of entry into the directory of assistant babysitters

  • the Directory of Assistant Babysitters is run by a Social Welfare Centre and it is accessible to the public on the Centre’s web pages.
  • the entry into the Directory of Assistant Babysitters is carried out at the request of an assistant babysitter, on the basis of which the Social Welfare Centre makes a decision on fulfilment of the conditions for an assisting babysitter and approves the entry into the Directory of Assistant Babysitters. An appeal may be filed against the decision on the applicant’s request to the Ministry
  • the Social Welfare Centre issues a certified excerpt from the Directory of Assistant Babysitters per request

b) Procedure for deletion from the Directory of Assistant Babysitters

  • the Decision of deletion of an assistant babysitter from the Directory of Assistant Babysitters is issued by the Social Welfare Centre when they determine that the assistant babysitter is no longer in compliance with the required conditions or on the request of the assistant babysitter
  • an appeal against the Decision of deletion of an assistant babysitter can be filed with the Ministry
  • the Centre performs deletion of an assistant babysitter from the Directory ex officio upon legal validity of the Decision on deletion from the Directory of Assistant Babysitters

c) Entry of amendments into the Directory of Assistant Babysitters

  • an assistant babysitter is obligated to report any changes of the information recorded in the Directory of Assistant Babysitters to the Social Welfare Centre with the purpose of entry of such changes into the Directory of Assistant Babysitters
