Building project management

Building project management activities include the following tasks:

  • financial, legal and technical consulting pertaining to the design, construction, use and removal of construction works;
  • financial, legal and technical preparation and planning of tasks pertaining to building, and monitoring the implementation of this plan;
  • programming and planning at the stage of project conception, which includes data collection, project programme development, and monitoring the implementation of this programme;
  • consulting, selecting and contracting tasks for designers, design auditors, supervising engineers, contractors,  certified geodetic engineers and other persons performing tasks pertaining to the building of construction  works, and consulting in contracting tasks with these persons;
  • linking and coordinating the work of designers, design auditors, supervising engineers, contractors, certified geodetic engineers and other persons participating in building, and supervision of their work for purposes of protecting the rights and interests of the investor;
  • obtaining acts, analyses, studies, expert reports and other documents necessary for the development of conceptual, main and detailed designs and of designs for the removal of construction works;
  • obtaining all documents and concluding all legal transactions required for the issuance of administrative acts for the implementation of physical plans, construction, use and/or  removal of construction works, and the obtaining of these administrative acts;
  • obtaining all documents and concluding all legal transactions required for the construction of a
    construction work and the performance of actions that the investor is required to perform during the construction of a construction work.
  • development of project control systems and monitoring and control of realisation, which includes preparation and presentation of planned timelines for execution with engaged resources, updating of initial plans in relation to project realisation, dynamic risk analysis throughout the life cycle of the project, reports on quality control of investment realisation, proposals for solutions of ongoing or envisaged problems in terms of time, technological and cost-related aspects of realisation.

FREEDOM TO PROVIDE CROSS-BORDER SERVICES

A legal or natural person – craftsman who pursues the activity of building project management and who is already established in another EEA country may temporarily or occasionally provide services in Croatia.

REQUIREMENTS FOR ESTABLISHMENT

A legal or natural person – craftsman established in another EEA state who pursues the activity of building project management may permanently perform the activity in Croatia under the same conditions as a person established in Croatia.

The building project management activity may be performed by a legal or natural person – craftsman, provided that:

  • it is registered for performing building project management activities
  • has a project manager in its employment.

A legal or natural person – craftsman performing the building project management activities in respect of a specific construction work may not be the contractor for this construction work.

The employee of a legal person or natural person – craftsman performing the building project management activities in respect of a specific construction work may not be the supervising engineer for this construction work.

Investors that are deemed to be public clients shall appoint a project manager when:

  • investing funds in the construction of infrastructural and other construction works, except roads, of a total investment value in excess of HRK 10,000,000.00 (EUR 1.327.228,08) before VAT;
  • investing funds in the construction of roads of a total investment value in excess of HRK 50,000,000.00 (EUR 6.636.140,42) before VAT;
  • investing funds in the construction of public purpose buildings of a total investment value in excess of HRK 35,000,000.00 (EUR 4.645.298,29) before VAT.
  • investing funds in the simultaneous construction of several buildings that are partly or entirely intended for housing, are built in the territory of the same city or municipality and have more than hundred apartments in total.

Requirements for project managers

A project manager is a natural person who:

  • has at least eight years of work experience in carrying out the relevant tasks, with an education in the scientific field of technical sciences in one of the scientific fields of: architecture and urban planning, civil engineering, electrical engineering or mechanical engineering;
  • has completed an undergraduate and graduate university study programme or an integrated undergraduate and graduate university study programme that awards the academic title of a Master’s degree or a Master of Engineering degree, or who has successfully completed the corresponding specialist graduate professional study programme in the above fields that awards the professional title of professional specialist engineer, provided that during his entire studies he earned at least 300 ECTS credits, or who has acquired in another manner the appropriate level of education and possesses:
  • an internationally recognised certificate of competency in project management; or
  • education in the scientific field of technical sciences in one of the scientific fields of: architecture and urban planning, civil engineering, electrical engineering or mechanical engineering with an educational programme that includes at least 30 ECTS credits in the fields relevant to the management of building projects.

Internationally recognised systems are:

  • competence certification system of the International Project Management Association (IPMA), based in Switzerland;
  • competence certification system of the US-based Project Management Institute (PMI).

Curricula include subjects in:

  • project planning and audit
  • building project management
  • contractual right to build
  • building regulations
  • human resources management
  • business system organisation in construction
  • organisation of construction.

Certified natural persons from another EEA state

The tasks of project manager may in Croatia be permanently performed by a certified natural person from another EEA state who has undergone the procedure for the recognition of foreign professional qualifications.


Recognition of qualifications  

Application for recognition of a foreign professional qualification for performing building project management activities:

The request shall be accompanied by the following documentation, in copies and translation, according to the general system:

  • copy of identity card
  • diploma/certificate and diploma supplement/certificate supplement
  • evidence of authorization to practice the regulated profession in the country of origin

or

confirmation from the employer that the candidate has pursued the profession for at least one year during the last ten-year period which preceded the provision of services, in case that the profession in the state of establishment of the certified person is not regulated

  • proof of paid fee

Legal remedies

You may submit a complaint within 15 days from the date of delivery of the decision.

The complaint shall be submitted to:

  • Croatian Chamber of Architects, Ulica grada Vukovara 271, 10000 Zagreb or at clanstvo@arhitekti-hka.hr for the architectural profession
  • Croatian Chamber of Civil Engineers, Ulica grada Vukovara 271, 10000 Zagreb or at info@hkig.hr for the civil engineering profession
  • Croatian Chamber of Electrical Engineers, Ulica grada Vukovara 271, 10000 Zagreb or at elektroinzenjeri@hkie.hr for the electrical engineering profession

The competent Chamber will reject the complaint (if it is untimely), will replace the contested decision with a new one (if the complaint is partially or fully founded) or will submit the complaint to the Ministry of Physical Planning, Construction and State Assets.

The Ministry may reject the complaint, annul the decision in part or in full, or amend it.

The decision of the Ministry shall be delivered to the party through the Chamber no later than 60 days from the submission of a proper complaint.

No appeal may be lodged against the decision of the Ministry, but an administrative dispute may be initiated with the competent Administrative Court of the Republic of Croatia within 30 days of receipt of the decision.
