Special conditions for water investigation works and other hydro-geologic works

I. Requirements for legal person to perform hydro-geologic investigation activities

  1. The legal person is established indefinitely and registered for hydro-geologic investigation and/or geo-physical surveying and/or drilling of boreholes and wells;
  2. The legal person is not in the bankruptcy procedure, unless there is a valid decision on the confirmation of the bankruptcy plan or liquidation;
  3. The legal person has at least one graduate engineer of geology in permanent full-time employment who has passed professional examination and has at least 5 years’ work experience in hydro-geologic investigation activities;
  4. The legal person is entitled to use at least one licensed mapping software;
  5. The legal person is entitled to use at least one licensed software to analyse hydro-geologic investigation data;
  6. The legal person has in its ownership the basic equipment for hydro-geologic investigation, at least the following: 1 geologic hammer, 1 compass, 1 groundwater level meter, and 1 field laboratory with the required probes for deep measurement of chemical parameters in groundwater (water temperature, electric conductivity, pH value, etc.).

II. Requirements for legal person to perform geo-physical surveying

  1. The legal person is established indefinitely and registered for hydro-geologic investigation and/or geo-physical surveying and/or drilling of boreholes and wells;
  2. The legal person is not in the bankruptcy procedure, unless there is a valid decision on the confirmation of the bankruptcy plan or liquidation;
  3. The legal person has at least one graduate geology engineer in permanent full-time employment who has passed professional examination and has at least 5 years’ work experience in hydro-geologic investigation activities;
  4. The legal person is entitled to use at least one licensed mapping software;
  5. The legal person has at least one graduate geology or mining engineer who has passed professional examination or one graduate physics engineer in permanent full-time employment with at least 5 years’ work experience in geo-physical surveying activities;
  6. The legal person has in its ownership equipment for geo-physical surveying for two or more methods: the method of geoelectric surveying or seismic prospecting or electromagnetic investigation or the georadar method or the borehole logging method, i.e. depending on the method at least: 1 geoelectric surveying instrument with the associated equipment and licensed software to interpret the measurement or 1 surveying instrument using the method of refractive seismics or shallow reflective seismics with the associated equipment and licensed software to interpret the measurement, or 1 electromagnetic investigation instrument with the associated equipment and licensed software to interpret the measurement or 1 georadar with the associated equipment and licensed software to interpret the measurement or 1 borehole logging instrument the associated equipment and licensed software to interpret the measurement;
  7. The legal person is entitled to use at least one licensed software to analyse geophysical surveying data;
  8. The legal person is entitled to use at least one licensed mapping software;

III. Requirements for legal person to perform the drilling of boreholes and wells

  1. The legal person is established indefinitely and registered for hydro-geologic investigation and/or geo-physical surveying and/or drilling of boreholes and wells;
  2. The legal person is not in the bankruptcy procedure, unless there is a valid decision on the confirmation of the bankruptcy plan or liquidation;
  3. The legal person has at least one graduate engineer of geology, geotechnics, mining, petroleum engineering or geotechnics engineer, in permanent full-time employment who has passed professional examination and has at least 5 years’ work experience in the drilling of boreholes and wells;
  4. The legal person has at least one skilled driller and two assistant drillers in permanent full-time employment;
  5. The legal person owns, leases or rents at least 1 borehole drilling machine with coring or 1 well drilling machine with the associated drilling tools;
  6. The legal person owns, leases or rents borehole redevelopment and development equipment, incl. at least one compressor and 1 air-lift;
  7. The legal person owns, leases or rents borehole or well survey equipment, incl. 1 submersible pump and 1 generator.

Necessary documents:

Attachments with an application for issuing a decision on the fulfilment of special conditions for water research works and other hydro-geologic works:

  1. An excerpt from the register of companies not older than 30 days, in the original or a copy certified by a public notary;
  2. A statement that there is no open procedure of bankruptcy or liquidation of the legal person or that a bankruptcy procedure is open, but there is a valid decision on the confirmation of the bankruptcy plan; in the original copy on which the signature of the legal entity’s legal representative is certified by a public notary;
  3. Required administrative fee;
  4. A list of the minimum required number of employees with the following information: name, surname, date and place of birth, place of residence, qualifications, profession, work experience in jobs corresponding to the profession, in order to prove that the special conditions are met, in the original signed by the legal entity’s legal representative;
  5. Employees’ professionl CV indicating the employer(s) that required work experience and the contact person to prove that the special conditions are met, in the original signed by the employee;
  6. Software licenses to prove that the special conditions are met;
  7. A list of equipment indicating a legal basis for their possession for each item (ownership, leasing or rent) to prove that the special conditions are met, in the original signed by the legal entity’s legal representative;
  8. A declaration under criminal and financial responsibility that the submitted documents are credible and substantially true, in the original copy on which the signature of the legal entity’s legal representative is certified by a public notary

Useful informations:

  1. Without the need to apply in person (saving at least half the time).
  2. No obligation for stamping (no longer a requirement for accessing the service market).
  3. No obligation for revenue markers (confirmation of online payment of a fee is accepted)
  4. The competent authority is obliged to issue an approval within 30 days (from date of duly submitted documentation, after the deadline for administration reply has expired).
  5. Once the approval is obtained, performance of this service activity can begin.

Decision that the special conditions for water investigation works and other hydro-geologic works have been met

Legal remedy:

An appeal may not be lodged against the decision; however, an administrative dispute may be instituted within 30 days. The legal remedy is an integral part of every decision.
