Detectives

 CROSS-BORDER FREEDOM TO PROVIDE SERVICES:

If you already have a registered establishment in another EU/EEA state, you are free to provide services on a temporary and occasional basis, without being registered within a competent authority. It is necessary to submit the following:

  • Statement before the first provision of the service (including personal data and data regarding details of every insurance or any other means of personal or collective protection considering professional indemnity)
  • Evidence on citizenship
  • Attestation of the country of establishment for exercising the profession of private detective and proving that at the moment of issuing the attestation he or she does not have a ban (temporary or permanent) on performing the profession
  • Evidence on professional qualifications (at least a degree of stručni pristupnik (professional title obtained upon finishing the professional study normally lasting less than three years and awarding less than 180 ECTS credits) or professional bachelor and evidence on passed examination of professional competence for private detectives in the state of establishment)
  • Any evidence that the person exercised the profession of private detective for at least a year in the last ten years (only if the profession, i.e. professional training for it, are not regulated in the state of establishment).

The statement is submitted for every year in which the person intends to temporarily or occasionally provide services (without resubmitting the already stated documentation).

APPLICATIONS FOR ESTABLISHMENT

  • Submits an application for the recognition of foreign professional qualifications containing:
  • Evidence on citizenship of the candidate (a regular copy and uncertified translation)
  • Evidence on formal education (at least a degree of stručni pristupnik (professional title obtained upon finishing the professional study normally lasting less than three years and awarding less than 180 ECTS credits) or professional bachelor)
  • Evidence on passed examination of professional competence for private detectives in the state of establishment,
  • Evidence on authorisation for performing the activities of private detective issued by a competent authority in the state of establishment (a certified copy and certified translation to Croatian)

Deadline: up to 3 months from the day of receiving the application in the correct form

 Appeals and legal remedies

The candidate has the right to appeal against the decision to the Ministry of the Interior within 15 days from the date of delivery of the decision.

Deadline for receiving the response: up to 60 days

Authorisation to perform detective activities

Applications for legal entities and sole trades

  • Filled request (Z 2A)
  • Appointing a person responsible within a legal entity authorised to perform the activities of a private detective
  • Concluded contract of indefinite duration with at least one private detective
  • Business premises arranged according to special spatial and technical conditions (surface of at least 40m2, which must contain a reception room for parties, an office, a waiting room, a makeshift weapons storage area and sanitary installations).

A sole trader can be authorised to exercise detective activities if he or she has:

  • Authorisation to perform the activities of a private detective
  • Business premises arranged according to special spatial and technical conditions.

Authorisation to perform detective activities (natural persons)

Conditions to issue an authorisation to perform the activities of a private detective are that the applicant:

  • Resides, that is that he or she is authorised to stay in the Republic of Croatia (not applicable to EEA nationals)
  • Has obtained at least the professional title of stručni pristupnik (professional title obtained upon finishing the professional study normally lasting less than three years and awarding less than 180 ECTS credits) or professional bachelor
  • Has completed an internship lasting for 12 months
  • Is medically fit, which is proved by a certificate of the competent health institution or occupational medicine specialist in private practice
  • Has not been finally adjudicated or no criminal proceedings have been initiated against him or her for a crime which is subject to ex officio prosecution (which is verified by the competent ministry of its own motion by examining the criminal and misdemeanour records of the Ministry of Justice or by the certificate of no criminal record issued by the competent court, except in cases of a criminal offence of causing a road traffic accident committed by negligence resulting in a bodily injury or material damage, or an equivalent offence in the country of his or her citizenship or in which he or she has residence)
  • Fulfils the security requirements
  • Has passed the examination of professional competence for a private detective
  • Knows the Croatian language and Latin script (not applicable to EEA nationals)

A person who has 3 years of work experience in the affairs of a police officer of the Ministry, military and police affairs of the Ministry of Defence, affairs of the State Attorney’s Office, affairs of a judicial police officer or member of the security services is considered to have fulfilled the requirement of a completed 12-month internship.
