Road transport

First option – FREEDOM TO PROVIDE CROSS-BORDER SERVICES

If you are established in any EU/EEA state, you are allowed to provide services of passenger and freight transport, regulating the access to road transport activities and access to the market on occasional and temporary basis, without obligation to register a company in Croatia.

The requirement is that a natural or a legal person has to obtain a Community licence to provide road transport of freight and passengers.

A statement needs not to be submitted considering that information on issued Community licences is available in the ERRU (National Electronic Register of Road Transport Undertakings) and to all competent authorities of Member States.

Second option – FREEDOM OF ESTABLISHMENT

If you are established in any EU/EEA state, you are allowed to provide services of national passenger or freight transport on a permanent basis in the Republic of Croatia with registration of establishment in Croatia and obtaining a national transport licence or a Community licence for providing services of national and international transfer.

It is also necessary to submit the following documents in electronic form:

  • Name and registered office of legal or natural person
  • proof of registration or registration of activities – due to simplicity of the procedure, it is proposed to deliver the proof; if such proof is not delivered, the competent authority will carry out verification ex officio, i.e. for EU/EEA nationals via the Internal Market Information System (IMI)
  • copies of vehicle licenses for lorries and buses to be operated
  • proof/certificate of passed examination of professional competence as transport manager
  • proof of financial standing of EUR 9 000 for the first and EUR 5 000 for each subsequent vehicle above 3.5 tonnes of maximum authorised weight and buses
  • proof of compliance with the conditions of good repute – an extract from the criminal records registry or an appropriate attestation of compliance with those conditions, issued by a competent judicial or administrative authority in one or more Member States where the transport manager or any other relevant person previously resided
  • proof of payment of administrative fee

Authorisation

A licence to carry out national passenger or freight transport

A Community licence to carry out international passenger transport or a Community licence to carry out international freight transport

Time-limit for obtaining the licence: 30 dana (from the day of receiving an orderly application with the required documents)

Legal remedy

An appeal is lodged to the Ministry of the Sea, Transport and Infrastructure against the decision of the administrative body in a county or the City of Zagreb on issuing a licence for the national passenger or freight transport.

Decisions of the Ministry of the Sea, Transport and Infrastructure on issuing a Community licence for international passenger or freight transport may not be appealed, but an administrative dispute may be brought before the competent administrative court.
