Special waste collection services

Requirements for adoption and implementation of the Decision on performing the service

  1. The special waste collection service for a particular category of special waste can be provided by a selected applicant in the tender for the provision of the above mentioned services in accordance with the decision adopted by the Environmental Protection and Energy Efficiency Fund (hereinafter: Fund) on the selection of the best tender for the provision of special waste collection services for a particular category of special waste in a particular area. The selected applicant cannot perform the service until he concludes a contract with the Fund on performing the indicated service.
  2. The public invitation to tender for the provision of special waste collection services shall be published in the Official Gazette, mass media and on the website of the Fund. The Fund shall take the decision on the selection of the best tender for the provision of special waste collection services for a particular category of special waste in a particular area, taking into consideration the following requirements:
    • availability of a sufficient number of adequately qualified personnel for the execution of the operational work programme,
    • availability of the funds or sources of finance necessary for the execution of the operational work program,
    • availability of the storage space, the staff, means of transportation and the necessary auxiliary equipment which ensures the collection and transfer of the collected waste from the producer to the storage facility, or to the person authorized for waste treatment, depending on the quantity expected to be produced in the area covered by the programme from the public tender based on the available data on the waste amounts generated over the last three years,
    • the proposed cost of special waste collection activities for the particular category of special waste.

Required documents:

  1. The programme for the provision of the special waste collection service shall include:
  • the national registration number, PIN, the name of the responsible person, the phone number and email address of the applicant,
  • types of special waste for which the programme is being submitted,
  • price offered for carrying out the special waste collection operations in the area covered by the programme.
  1. In addition to the programme for the provision of the special waste collection service, the following shall also be submitted:
  • a permit for carrying out special waste collection activities with respect to the specific special category of waste covered by the programme,
  • an excerpt from the Register of Companies or the Register of Crafts and Trades,
  • a copy of the employment record or the employment contract,
  • evidence of compliance with all the requirements for the selection of the most acceptable programme for the provision of the special waste collection service, including an operational work programme and a detailed plan.

Further requirements:

  1. A person intending to enter into a contract with the Fund for the provision of a special waste treatment service for a specific category of special waste shall obtain an authorisation from the Ministry.
  2. The Ministry shall issue a public invitation for the submission of applications for such authorisation and publish it in the Official Gazette, mass media and on the Ministry’s website.
  3. The application for authorisation shall contain:
  • the national registration number, PIN, the name of the responsible person, the telephone number and email of the applicant,
  • types of special waste for which the authorisation is requested.
  1. The application shall be accompanied by:
  • an excerpt from the Register of Companies or the Register of Crafts and Trades,
  • permit to treat the relevant waste,
  • a copy of the employment record or the employment contract,
  • evidence that the requirements set out in the Act on Sustainable Waste Management have been fulfilled, including the operational work programme.
  1. The Ministry shall grant the authorisation to a person who meets the following requirements:
  • has at his disposal the plant and the equipment that meet the relevant technical and technological requirements with respect to waste treatment when the treatment results in a new product, energy or source material which, when treated, ceases to be waste, to possess organizational skills for the fulfilment of an annual operational work programme, and to have at his disposal the plant and equipment that meet the relevant technical and technological requirements with respect to waste disposal when waste treatment in the meaning of generating new source materials, products or energy cannot be carried out or is not cost-effective,
  • such plant and equipment are capable of treating the amount of waste which, according to the available official data on the amount of waste generated in the last three years, is expected to be generated in the territory of the Republic of Croatia,
  • to have in place an annual operational work programme which explains in detail the capacities to meet the requisite requirements,
  • to have available a sufficient number of personnel with adequate qualifications for the execution of the annual operational work programme.

Useful informations:

  1. Without the need to apply in person (saving at least half the time).
  2. No obligation for stamping (no longer a requirement for accessing the service market).
  3. No obligation for revenue markers (confirmation of online payment of a fee is accepted)
  4. The competent authority is obliged to issue an approval within 30 days (from date of duly submitted documentation, after the deadline for administration reply has expired).
  5. Once the approval is obtained, performance of this service activity can begin.

An appeal may not be lodged against the decision, however an administrative dispute may be instituted. The legal remedy is an integral part of every decision.
