Energy performance certification and energy auditing services

First option – FREEDOM OF CROSS-BORDER PROVISION OF SERVICES

If you already have a registered establishment in another EU/EEA country, you are allowed the freedom to provide services on an occasional and temporary basis, without the obligation to register an establishment in Croatia.

In this case, before the first provision of the service, an e-declaration shall be sent via e-service or at zahtjevi.energcert@mpgi.hr, accompanied by a photographed or scanned submission of the following information or documentation:

For a natural person:

  • Form B completed and signed (according to the ordinance)
  • proof of nationality;
  • proof of establishment in another EU/EEA country;
  • confirmation by the competent authorities of the country in which the applicant is established that, at the time of issuing it, there is no prohibition, even temporarily, to carry out activities;
  • Proof of professional qualifications:

a) confirmation by the competent authority of the EU/EEA state from which the applicant comes on the Regulation of the profession and fulfilment of all requirements for the practice of the profession in that country – where energy performance certification and energy auditing of the building is a regulated profession in the country of origin of the applicant;

b) proof of successful completion of formal education of architectural, construction, mechanical or electrotechnical professions (at least 300 ECTS credits, a diploma obtained in an EU/EEA state or other evidence issued by a competent authority of a third State and a foreign person has three years of professional experience in the territory of an EU/EEA state and confirmed by that EU/EEA state,

c) attestation of professional experience or proof from the employer of professional experience acquired for at least 5 years after the completion of the formal education of the architectural, construction, mechanical or electrotechnical profession,

d) confirmation by the employer from the EU/EEA state that the applicant has carried out the profession of energy performance certification and energy auditing of the building for one year full-time or part-time equivalent to the total duration over the previous ten years in the EU/EEA state where that profession is not regulated,

e) proof of professional training and training in the field of energy performance certification and energy auditing of buildings, if training and training programmes in the field of energy performance certification and energy auditing of buildings are implemented in the Member State of origin,

f) proof of the existence of a professional title in the country of establishment;

  • proof of professional liability insurance
  • proof of registration in the relevant register of authorized persons, if the EU/EEA state maintains such register (if proof is not provided for EU/EEA state, the competent authority will verify via IMI system).

Evidence shall be submitted in plain copy and uncertified translation into Croatian, except for evidence of professional qualifications that shall be submitted in certified copy and certified translation into Croatian.

For a legal entity:

  • Form A completed and signed (according to the ordinance)
  • proof of establishment in another EU/EEA country (if proof is not provided for EU/EEA state, the competent authority will verify via the IMI system);
  • confirmation by the competent authorities of the country in which the applicant is established that at the time of issuing it there is no, even temporarily, prohibition of performing activities (if proof is not provided for EU/EEA state, the competent authority will verify via IMI system);
  • Proof of professional qualifications of the natural persons who will perform energy performance certification and energy auditing of the building on behalf of the legal entity:

a) confirmation by the competent authority of the EU/EEA state from which the applicant comes of the notification of the Regulation of the profession and of the fulfilment of all requirements for the exercise of the profession in that country — where energy performance certification and energy auditing of the building is a regulated profession in the country of origin of the applicant;

b) proof of successful completion of formal education of architectural, construction, mechanical or electrotechnical professions (at least 300 ECTS credits, a diploma obtained in an EU/EEA state, or other evidence issued by a competent authority of a third State and a foreign person has three years of professional experience in the territory of an EU/EEA state and confirmed by that EU/EEA state),

c) attestation of professional experience or proof from the employer of professional experience acquired for at least 5 years after the completion of formal education of the architectural, construction, mechanical or electrotechnical profession of the natural persons who will perform energy performance certification and energy auditing of the building on behalf of the legal entity;

d) confirmation by the employer from the EU/EEA state that the natural persons who, on behalf of the legal entity, will perform energy performance certification and energy auditing of the building carried out the profession of energy performance certification and energy auditing of the building for one year with full-time or part-time equivalent to the total duration over the previous ten years in the EU/EEA state where that profession is not regulated,

e) proof of professional training and training in the field of energy performance certification and energy auditing of buildings, if training and training programmes in the field of energy performance certification and energy auditing of buildings are implemented in the Member State of origin,

f) proof of the existence of a professional title in the country of establishment

  • proof of professional liability insurance
  • Proof of registration in the relevant register of authorized persons if the EU/EEA state maintains such a register.

Evidence shall be submitted in plain copy and uncertified translation into the Croatian language, except for evidence of professional qualifications of the natural persons who will perform energy performance certification and energy auditing of the building on behalf of the legal entity, that shall be submitted in certified copy and certified translation into Croatian.

Upon receipt of e-declaration, the competent authority checks whether the applicant meets the legal conditions to temporary or occasionally provide services of energy performance certification and energy auditing of a building in accordance with regulations in the Republic of Croatia and issues a certificate to this effect, which is automatically entered into the Register of Authorized Persons maintained by the Ministry, via the Energy Performance Certificate Information System (IEC).

The energy certificate is created electronically and printed exclusively via IEC in Croatian language in accordance with the regulations in force in the Republic of Croatia.

The application must be renewed once a year if the service provider intends to provide services in the Republic of Croatia on an occasional or temporary basis during that year.

Second option – FREEDOM OF ESTABLISHMENT

If you are a registered establishment in another EU/EEA country, you are allowed as natural and legal persons to provide services on a permanent basis, with the registration of an establishment in Croatia and to submit the following documentation sent via e-service or at zahtjevi.energcert@mpgi.hr:

For a natural person:

  • proof of educational qualification: graduate university study or specialist graduate professional study of architectural, construction, mechanical or electrical engineering (at least 300 ECTS credits);
  • proof of professional qualification: at least 5 years of work experience in the profession or 2 years of work experience in the design and/or professional supervision of construction after completing the studies;
  • proof of completed vocational training programme (Module 1 or Module 1 and Module 2) with one of the holders of the training programme;
  • exceptionally: the authorisation for energy performance certification and energy auditing of buildings with a simple technical system shall also be granted to a natural person who has completed undergraduate university or undergraduate professional study of architectural, construction, mechanical or electrotechnical profession, or who has obtained the title of engineer of architectural, engineering, mechanical or electrotechnical profession (higher education) according to previous educational programmes, and who has had at least ten years of work experience in the profession or five years of work experience in design and supervision, after completing the studies.

Recognition of qualifications

An application for recognition of a qualification (completed and signed form C of the ordinance) shall be submitted via e-service or at zahtjevi.energcert@mpgi.hr, with the following documentation:

  • proof of citizenship;
  • proof of successful completion of formal education of the architectural, construction, mechanical or electrical engineering professions;
  • certificate of the competent authority of the EEA Member State from which the applicant comes on the Regulation of the profession and fulfilment of all requirements for the practice of the profession in that country – in case energy certification and energy inspection of the building is a regulated profession in the country from which the applicant comes;
  • proof of professional training in the field of energy certification and energy audits of buildings, if training and training programmes in the field of energy certification and energy audits of buildings are implemented in the Member State of origin;
  • proof of professional experience of at least five years after completion of formal education of the architectural, construction, mechanical or electrical engineering professions;
  • proof of the existence of a professional title in the country of establishment;
  • proof of knowledge of the Croatian language at B2 level (certificate issued by an authorized institution);
  • proof of professional liability insurance
  • proof of registration in the relevant register of authorized persons, if the EEA state maintains such register;
  • confirmation by the employer from the Contracting State that the person has carried out the profession of energy certification and energy inspection of the building for one year with full-time or part-time equivalent to the total duration over the previous ten years in the EEA State where that profession is not regulated.

Evidence shall be submitted in certified copy and certified translation into the Croatian language, except for proof of citizenship, proof of the existence of a professional title, proof of knowledge of the Croatian language, proof of professional liability insurance and the employer’s confirmation, which shall be submitted in plain copy and uncertified translation into the Croatian language.

Provision of a regulated profession of energy certification and energy inspection of the building of Croatian citizens (authorized natural persons and authorized legal entities) in EEA Contracting States

The application shall be submitted via e-service or at zahtjevi.energcert@mpgi.hr:

The natural person shall submit a completed and signed form 1 (of the ordinance).

The legal entity shall submit a completed and signed form 2 (of the ordinance) and an extract from the court register (original or certified copy not older than 6 months).

Authorization

Decision on granting authorization for energy certification and energy inspection of buildings (also encompassing authorization for regular review of heating and cooling or air conditioning systems in the building)

Deadline: 30 days


Legal remedies

No appeal is allowed against the decision, but an administrative dispute may be initiated before the locally competent administrative court within 30 days from the date of delivery of the decision.
